In one case, Rich Berkon’s client was drinking and wanted to carve his name into the door of a downtown bar when two bouncers tried to escort him away. The client stabbed both bouncers. The prosecution charged the client with attempted first-degree murder and he faced 25 years to life. Richard Berkon argued that the bouncers attacked his client while using racial epithets and that his client only used the knife after the bouncers seemed ready to attack again. During the preliminary hearing, Rich Berkon questioned the bouncers and got them to confess that they originally beat up the client after escorting him away from the bar. Richard Berkon managed to get his client a deal for assault with a deadly weapon and three years in state prison. Richard Berkon also provides legal services to people accused of embezzlement. In one San Diego County case, a woman in charge of a corporation’s petty cash account embezzled $90,000 over three years. When caught, she faced four years in state prison. Rich Berkon managed to get his client probation and no jail time by explaining that she was married with children and that her embezzlement was born from her gambling and meth addiction. In another embezzlement case, Richard Berkon defended a department store’s security officer who worked with her husband to steal merchandise; she faced four years and four months in state prison.
