Filing a lawsuit for personal injury in the workplace:
Filing a lawsuit for personal injury in the workplace can be a complicated and daunting task, but the process is eased by the expertise of qualified attorneys like those at Gordon, Elias & Seely, L.L.P. While each specific lawsuit is different and dependent on the plaintiff’s case, all civil suits share certain general stages: (1) The plaintiff will be required to file a report about the accident detailing his/her injuries and causes, with his/her employer. This "Injury Report" will spur an investigation into the cause of the accident. Unfortunately, if the plaintiff has not retained counsel, the only party doing the investigation is the party who wants the plaintiff to "be at fault". Thus, the plaintiff should meet with an attorney as soon as possible so that the attorney can also perform an investigation on behalf of the client; (2) After the investigation is performed, the medical care is monitored and, when the plaintiff has reached their maximum level of medical improvement, a pre-lawsuit may be attempted; (3) If a settlement is not reached, the Gordon, Elias & Seely, LLP will file an actual lawsuit by filing a complaint thereby giving the employer approximately 20 days to formally respond once served. The employer will then issue a formal response to the allegations; (3) At this point, the case enters discovery, during which time the parties exchange documents and take depositions of the parties and witnesses; (4) Most cases will then be ordered to mediate and, if a settlement agreement is reached after the employer makes a reasonable offer, the case should conclude; (5) However, should the offer be less than what the injured plaintiff should receive and after the client has been fully advised of all the potential risks and benefits of going to trial; (6) the case will go to trial.
